ABSTRACT: This article was conducted with the aim of studying the peculiarities of the auction, and its need to modernize and adapt to new Brazilian reality. Accordingly, this study aimed to discuss and propose ways Main faster procedure adopted for the auction. Through literature review of the topic and research of documents and draft laws, the results led to understand that the relevant legislation to Leiloeiros and the administrative procedure of the auction needs to be modernized. It also shows that there are internal problems within the public service that must be solved together with the legal problems so that the Administration can get more profit. It is understood, although the proposed solutions, not create difficulties for the free exercise of the profession of auctioneer and not for the conduct of auctions. What in fact is intended, is to facilitate and expedite administrative procedures, avoiding the waste of public money.
